Can i still file my taxes using himeven if he's going to be 19 n feb even if he is a full time student n schoo?

okay my nephew has been stay in with me now for about 3 years and n February of 09 he will be 19 and i wanted to know if i would still be able to claim him as my dependent on my taxes....even if he is still a full time student n school? YES! You can claim him as a dependent as long as he is living with you.
  • You sure can as long as you provide more than half his care you can as long as he is a student or lives in your house and don't file for himself!
  • If you have been doing it before and it was legal, I'm sure it's okay.

    I do know that a legal dependent (son/daughter) can still be claimed on tax returns as long as s/he is a FULL TIME student AND you provide over half of his support.

  • If he's a full time student, he can be claimed up to and including when he's 23, assuming he meets the other requirements to be claimed. The "under 19" is just for someone who it NOT a full time student.

  • Yes you should claim him on your return. Just make sure that it is beneficial for you, because sometimes it may be more beneficial for the student to claim themselves on their own return. I have several clients where their income is low enough and they have enough credits that the student will benefit more from their own exemption. And remember just because one year it is more beneficial for him to claim his own exemption; it may change the next year.
